Commercial and residential property disputes

Our property litigation specialists work closely with landowners, property investors, commercial landlords, developers, property management companies and property occupiers to resolve disputes in a cost-effective and timely way.

Helping you protect your family’s land and property

Your home should be a place of safety and sanctuary. We know that when property disputes arise, that sanctuary can feel threatened. Our team will provide assurance, guidance and advice to help you protect your property.

We can advise in relation to all aspects of property litigation, including boundary disputes, adverse possession claims, trespass, Party Wall Act 1996 claims, right of way and right to park disputes, right to light claims, subsidence and nuisance. We will work with you to understand your aims, advise you on your options and act for you to resolve disputes effectively.

Helping your business to thrive

We have extensive experience of working with commercial landlords, and tenants, in relation to an array of leasehold disputes. We can act for you in relation to claims for renewal leases under the Landlord and Tenant Act 1954, rent arrears claims, breaches of covenant, forfeiture and repossession, dilapidations claims, tenant insolvency, claims against guarantors, withholding of landlord consent, rent reviews and arbitration, exercising of break clauses and termination of leases.

The team is also experienced in statutory claim cases which involve the Coal Mining Subsidence Act 1991 and the Land Compensation Act 1973 and Gas (Street Works) (Compensation for Small Businesses) Regulations 1994.

Trusts of land and equitable interests in land

Legislation related to land can be complex, extensive and detailed. Our property dispute team can provide clear, incisive guidance on the steps to take when considering claims for and equitable interest based on implied trusts or estoppel, claims pursuant to the Trusts of Land & Appointment of Trustees Act 1996 (TOLATA) and claims for vesting orders and bona vacantia issues.

Professional negligence claims

You are entitled to expect your professional advisers to act in your best interests, know what they are talking about and provide you with a competent level of service. Unfortunately, this is not always the case, and the results of professional negligence can be very costly for you and your business.

Commercial and property matters involve a wide range of professional services; solicitors, surveyors, accountants, planning consultants, pension trustees, civil/structural engineers or architects. Where your professional adviser has been negligent, our team will work with you to formulate your claim and obtain the best outcome for you.
